US — Ashburn, Virginia. For the second time, a girl has reportedly been raped in a girl’s restroom of a US school by a “gender-fluid” male student. The sexual violence set into play a course of events that led to the arrest and conviction of her father on charges of Disorderly Conduct. The male student is accused of kidnapping and sexually molesting a female student in an empty classroom of a different school months after the restroom attack.

On May 28, a boy dressed in a skirt entered a girls’ restroom at nearby Stone Bridge High School, and raped a girl, Scott Smith, the father of the ninth-grader who was attacked, told the press.

Elizabeth Lancaster, a lawyer for the father, said the boy has been charged with two counts of Forcible Sodomy, a count of Anal Sodomy and a count of Forcible Fellatio in relation to the incident.

All juvenile records are sealed, but the Loudon County Sheriff’s Office has confirmed a case involving “Offense: Forcible Sodomy [and] Sexual Battery” had stemmed from a May 28, 2021 incident at Stone Bridge High School, and is “pending court proceedings” following “a thorough two-month-long investigation.”

On June 22, the girl’s frustrated father joined with other parents at a Loudoun County, Virginia school board meeting to protest school transgender policy.

At the time, Scott Ziegler, who was appointed Loudoun County Public Schools Superintendent in June after serving six months in the position as an interim, assured parents their concerns were unfounded. “We don’t have any record of assaults occurring in our restrooms,” he claimed. “The predator transgender student or person simply does not exist.”

Mr Smith became enraged at the Superintendent’s words, which he deemed false. Mr Smith was arrested following a heated exchange with a female progressive activist wearing a rainbow heart shirt who said she she did not believe his daughter’s claim of sexual assault. He was ultimately handed a sentence for disorderly conduct, which will be suspended following a year of good behavior.

The June 22 gathering of parents to protest the transgender policy was declared “unlawful assembly,” and Mr Smith was banned from all future school board meetings.

The school board approved the transgender policy on August 11, which requires schools officials to call a student by the pronouns of the sex the student identifies with, and calls for restroom renovations to permit more privacy.

In June, LCPS lectured the public for worrying about a "red herring," saying the district had 0 bathroom assaults on record. It quietly transferred the boy charged in the May 28 assault to a new school.

According to investigative reporter Luke Rosiak, the boy accused of sexual violence was transferred to Broad Run High School in Ashburn.

On October 6, the sheriff’s office announced that a 15-year-old male student at Broad Run High was charged with Sexual Battery and Abduction after he sexually assaulted a fellow student, forcing her “into an empty classroom where he held her against her will and inappropriately touched her.” The suspect is being held at the Loudoun County Juvenile Detention Center. A government official confirmed that the suspect has the same name as the boy accused of sexual violence against Mr Smith’s daughter.

This is not the first incident of a male student who identifies as ‘gender fluid’ purportedly engaging in sexual violence against a girl in a girls’ restroom. On November 16, 2017, a male student at Oakhurst Elementary School in Decatur, Georgia who self-identifies as “gender non-conforming” entered a girls’ restroom while a 5-year-old girl was inside. The boy pushed her up against a wall and raped her with his fingers as she cried for him to stop. According to Pascha Thomas, the girl’s mother, the school refused to take action, instead retaliating against her by calling the Department of Family and Children’s Services. Prosecutors declined to press charges against the suspect due to his young age. Ms Thomas subsequently removed her daughter from the school.

A juvenile court judge “determined the evidence presented was sufficient for a finding of guilt on both counts” against the 15-year-old male in regards to the restroom incident, Loudoun County Commonwealth’s Attorney Buta Biberaj said.

A day later, concerned parents, students and staff of multiple schools staged a walk out in protest of the county’s handling of the incident. Calls for the Loudoun County Public Schools Superintendent and school board to be fired intensified after it came to public light that Mr Ziegler had sent the school board an email notification that “a female student alleged that a male student sexually assaulted her in the restroom.” The email was sent the date of the reported assault, despite the Superintendent’s claim a month later to have no knowledge of assaults in school restrooms in the county.

John Beatty, the Catoctin District member of the board, is among those calling for Mr Ziegler’s resignation. He accused the Superintendent of “withholding information for political gain,” telling Fox:

[T]he superintendent was working to aggressively pass a policy [8040] that would have allowed unrestricted access of biological males to female restrooms. He didn’t provide information because if it came out that there was an assault in the bathroom, the transgender policy wouldn’t have passed.

Sentencing is expected to follow the boy’s second trial, in which the court will hear evidence for the Sexual Battery and Abduction charges in relation to the reported classroom incident. He remains in detention.

The mainstream media is now calling the student convicted of the sexual violence a “boy,” and eliminating any mention of his transgender identity.

Mainstream media had widely portrayed Mr Smith as a conservative gone wild in memes of the father’s arrest that went viral.

On November 15, the 15-year-old pleaded no contest to charges of Abduction and Sexual Battery in relation to the second incident, which took place in a classroom.

The Loudoun County school settled with Tanner Cross, a teacher at Leesburg Elementary who sued the school board and Superintendent Ziegler over its policy requiring educators to address transgender students by their pronouns. The teacher had been suspended after he refused to use preferred pronouns, calling it “lying to a child,” “abuse to a child” and a sin against God. The school board has agreed to permanently reinstate the teacher, remove record of suspension from his file and compensate $20,000 of his legal fees. A part of the lawsuit will move forward, as two other teachers have joined, alleging the policy violates their beliefs, too.
